Recent changes to the Fair Work Act under the ‘Closing Loopholes’ laws have made the 'right to disconnect' legal in Australia. From August 26, 2024, workers can refuse to monitor or respond to work-related emails or calls outside their rostered hours, unless it's unreasonable. Disputes should first be resolved at the workplace level, but can be escalated to the Fair Work Commission if needed.
